There are two videos in this thread that clearly and unequivocally demonstrate the problem of moving well outside of the red and still being hit. Why you or anyone else would deny this is a real problem boggles my mind.

Isn't FCC an American thing? I know ISPs can throttle to their hearts content here as long as they tell you about it. That's how they sell the more expensive packages which don't have it![]()

Yeah it is. But masked is being a bit misleading, unintentionally of course.
It is only illegal to selectively throttle a specific protocol, like say bit torrent, at the ISP level, while allowing all other protocols to pass with no throttling.
They can however throttle all traffic equally and be within the law. Its much like racial or gender discrimination, but for internet traffic.
Comcast lost a big case over throttling Bit Torrent, and lieing about it.
Also I have seen a lot of people talk about bandwidth caps. While this is certainly a thing in many countries, it is not predominant in the US. There are exceptions, Comcast forces you into it and Time Warner allows you to choose to have one. Unfortunately we here in the US usually do no have a choice with ISP. They have a monopoly in most areas. Basically regulators say; Time Warner and Cincinnati Bell are the only ISPs allowed to serve the Northern Kentucky area. This is the case almost everywhere in the US. Less than a handful of ISPs are allowed to serve a given area.
Indeed, I only meant to highlight the nuance of that ruling. No disrespect meant Masked, you are more knowledgeable on network routing than I am.
Also Masked or anyone really. While you are doing your packet inspections can you yank out the MAC address of the server you are connecting to? Might be useful in determining if certain servers are shittier than others.
