They removed the 35 day penalty. There was a timer in your timer page, and suddenly they removed it without saying anything in notes or whatsoever.

For example:
On my server there is one plot that was sold the day personal housing came out - just around the corner of my S Personal house. There was nothing ever built on it, and the owner is a lvl 20 character...

Right next to my house is a medium FC house, 1 member, nothing has changed in or around the house for 9 month or so

so yeh, people could have houses - but inactive ones do not fall back in the pool....
