We are now paying customers, so when can the service be used?

Read the license agreements etc. Just because your "paying" to use this service dose not mean you have the right to demand anything from it.
You do not own or part own anything you are paying for other than a useless game DVD sold to you in a box(if that). You are just paying for the opotunity / chance to play this game as and when SE deem it so.

If you cant understand that then maybe you should not be playing this type of game at all.....

Holy hell I have seen it all now lol. If you pay for a service you may not be entitled to dictate the contents of that service.....but you ARE entitled to THE SERVICE itself. Everyone here can demand a refund from their credit card company today for denial odf service and they will get it. You are ALWAYS entitled to receive what you pay for. Where do you people come from? No wonder MMO companies do this, they know they can because there are enough of you out there to allow it.

You know flat out lying isn't going to help you argument. There as far as I can tell yet to be a time where there was not at least one server you could log into. Just because it was not one you want to play on does not make it denial of service.

Please understand this is a base right, and no EULA can overide it. So yes by our rights we can, and should be upset when presented with a product that is Misrepresented as a final release, Delivered as a unusable product, and provided with unsatisfactory communication from the company.

I however am patient, I have not requested a refund, as yet, however at this point am fully entitled to one if I do request it.

Nice interpretation of the TOS but that is not exactly what it says. It refers to service not being available during maintenance and to service not being available due to circumstances beyond SE's control (i.e. natural disasters). That is all it says.

Maintenance is part of the game and is not what people are complaining about. What they are complaining about is the fact that everyone paid to play the game and large number of them have not been able to play due to login limitations and character creation restrictions. SE put these in place after several maintenance sessions failed to fix game breaking issues so essentially, they are providing a service to some while denying to others so that those that receive the service have a better game play experience. This is not covered by any TOS or EULA.

First off, couldn't have just said self entitlement? Self entitled self? Really? Anyways.

You clearly do not understand the law of business, so please don't condescend to the posters in this thread. There is a basic agreement made that A) that if you pre-order the game, you get early access. Many people did not get their codes, could not use their codes, or could not access the servers at all during early access. This alone is enough to issue a refund. No TOS can negate the promise made at purchase. B) No TOS would be upheld when no service is provided. This is a game that is unplayable due to purposeful manipulation server side. You can pretend that users signed their life away with the TOS, but that's just not how this works.
