Yep, they qualify, hence "eligible", not they are 100% in the beta. Don't see why legacy players are getting hate now ever since they announced that they're only eligible to enter.
Rule of thumb when it comes to NDA: If it's been publicly revealed by said company, NDA doesn't cover that.
Since it's been revealed that legacy players will be in the Beta, it is safe to say that you are a legacy player in the Beta.
You can say that, however it doesn't make it true. I have legacy status on my account. What if I don't want to test the beta because I don't like spoilers, don't want to repeat the content, or don't want to deal with bugs. Does this still mean I'm a legacy player in the beta?
It's a known fact that legacy players have a better chance of getting beta access, and many of us with the status probably told all our friends about it months ago. You just can't share info about the actual came itself until the devs decide the time is right to lift the NDA.

Here's a thought to add to the confusion if you follow the strict rules.
Saying you will be a beta tester and saying you are a beta tester is two different things. Since there is no beta test yet and no agreement you can sign then if you right now say your a beta tester you are actually lying. Saying you will be a beta tester is not breaking the agreement since you haven't signed it. Also it doesn't mean you will be a beta tester. You could change your mind or some forum moderator plays a sick joke revoking your beta access.
Once you read the agreement if it says the identity of the tester is confidential information and confidential information must be kept confidential then you can't tell anyone outside of the beta test you're a beta tester once you sign the agreement. You can post it on the beta test forums, but then that would be a little silly. New beta tester: I'm a beta tester! Other beta testers: No !@#$, we all are!![]()

SE themselves said you could do this during the alpha. Generally, it is allowed such that you can put it on a resume and/or not have to tell a lie if someone talks to you and asks what you're doing. The agreement states you're not supposed to disclose any confidential information about the product. It doesn't explicitly state you can't acknowledge your participation. SE is not going to ban you for saying "I'm in the beta." They will however probably ban you if you say "In the beta you can do this and we're testing that and yada yada and oh here's a video of it."I like to see the source for information #1, because the alpha tester agreement says otherwise. The agreement explicitly says you can't say you're an alpha tester. I link and highlighted the agreement a few pages back.

When it comes to NDA breeches, all SEs resources will be going into preventing websites and people posting info that they shouldn't be. They won't have the time to look into minor NDA breeches that aren't going to harm the game like revealing you are a tester. It's the same attitude police take to crime. They have to prioritise the most serious ones.
