Devs: Announcing Legacy status = Beta NDA breech?

You guys are beautiful, and I don't know what I'd do without you; but as much as it reassures me that you guys think this question is dumb, I posted this thread for the purpose of getting an official answer so that I don't have to worry about it coming back to haunt me later. Call me paranoid, but I've been faced with stupid crap like this before.

Its not a dumb question but i do really think you are over thinking it.. it would be silly to loose your chance to participate in the beta for telling someone you have legacy status when SE has already stated all legacy members are qualified so being kicked for prior knowledge is kinda bleh :P

Right, but if that's true are they even going to bother telling people to keep their beta access secret? Surely if it's okay for some of the people to do it, you might as well let everyone do it.

well in terms of keeping it a secret yea until phase 4 when NDA is lifted like on other websites other than the Beta forums. that said though at the start of phase 3 when others who applied such as non legacy members get in everyone who is on the forums would already know whos in the beta.

You still have to keep secret the fact you are participating in the alpha test. We will have to wait for beta test agreement to see if it still holds true for the beta. If you're legacy member doesn't mean you are participating in the beta test.

Below is details from agreement that shows you cannot say you're a tester. Once the beta test agreement gets released look for this.

Alpha Tester’s Confidentiality Obligations
“Confidential Information” shall mean (a) any and all information relating to or contained in the Products, Software, Documentation, or other materials supplied to Alpha Tester by Company in connection with the Alpha Testing, including, without limitation, information relating to the performance, conditions, capabilities, and contents of the Products and Software, methods of reporting and conducting, modification schedule, modification process and its progress in the Alpha Testing, AND RECIPIENT’S FEEDBACK, OPINIONS, SUGGESTIONS, AND COMMENTS (POSITIVE AND/OR NEGATIVE) REGARDING THE PRODUCT AND THE SOFTWARE, (b) the existence and the terms of this Agreement, (c) the Square Enix ID and password used by Alpha Tester, or by any other Alpha Tester, (d) THE IDENTITY OF ALPHA TESTER AND THE FACT THAT ALPHA TESTER IS PARTICIPATING IN THE ALPHA TEST, and (e) any and all information relating to the future or proposed products, services, or business operations of Company. Confidential Information includes, without limitation, all such information disclosed to Alpha Tester prior to the execution of this Agreement. Alpha Tester acknowledges and agrees that the Confidential Information constitutes valuable trade secrets of Company and (subject to the other terms of this Section 2.6) agrees to keep Confidential all Confidential Information, and only use Confidential Information in connection with Alpha Tester’s participation in the Alpha Test.

If we get into Phase one, i know after each phase our character is deleted, but do we get to play through all 4 phases?

Since in the road map shows SE is adding more servers for each phase, I'm assuming SE plans to keep the testers through each phase and add more.

I'm pretty sure we will find out more information pretty soon(probably on the 7th) based on this statement in road map:
"* Please access the Beta Tester Application Site (opening early January 2013)
for more information on the beta schedule and application procedures."
