It's morally reprehensible. People should do the right thing because it's the right thing to do, not because of the punishment if they don't.

It is morally reprehensible by your code of ethics sure but maybe not another's. That is why I say enforcement is important it gives people who do not care about the rules but care about the consequences a reason to follow.
