The ESRB and PEGI rating systems only take game content into consideration when deciding the rating, they explicitly do not consider potential online interaction for rating purposes. This is exactly why there is always a disclaimer for any game with an ESRB or PEGI rating with any online component, where they state that online interaction may vary from the given rating.

You don't seem to understand that in most cases the rating systems are in no way legally binding. The ESRB and PEGI are non-government, industry run, organizations. The only rating system with some teeth is Austrailia's, which is actually government run, however they also do not consider online interactivity as part of their domain. I suppose China's is pretty strict, but that's a whole different animal as FF in China is run by an entirely different publisher and not relevant to the current conversation of SE run FFXIV.

From the ESRB themselves in short the DEVELOPER not the ESRB can catch Hell for not making sure the games content meet the rating. I never said the ESRB is responible for mainting a rating the developer is..

Of course they are, but that 'responsibility' doesn't equate to any legal or financial repercussions like you keep trying to claim.
FFXIV being a teen rated game is only within the scope of the playable content that SE developed. It has nothing to do with what players choose to do within the game itself. Neither does it impose any hinderance, legal or otherwise, that would stop two consenting adults from engaging in lascivious behavior in private channels in the game.
The only thing at stake is the reputation of SE and the game. With regards to that, Yoshi P has come out and stated in a prior live letter that anything done within the game between two consenting adults is not their business so long as it's done in private channels. If it's done in public, or not all parties involved consenting (keep in mind that minors cannot consent), then report it if you see it and SE will take action against the offender/s if they are violating SE's policies. Or if the issue is egregious enough to run foul of real life law, they'll get law enforcement involved.

You can be upset about it as much as you want, but that won't change the fact that ERP is considered acceptable under specific circumstances. If it happens outside of those circumstances, then report it. Otherwise, it's simply just none of your business and you should ignore it.

Hence why people are punished for ERP in game when reported, two adults are fine but SE does not know which players are adults and minors.
