If that is the case what stops SE from looking at the hair and try to remodel it as real ingame hair? Since people want longer hairstyles anyway, they could just use his as a base.

Probably nothing. (Well, allocation of time and resources, but technically nothing.) Still it's a reason why it's currently not in a state that it can just be released as-is, thus possibly why Yoshi-P might say it can't be done "because he's an enemy".
