They would have to give a percentage that would be a violation. Perhaps 200% or more mark up from default listing for plot+house would be 'too much' for example. Especially once you consider the player buying has to pay a player to vacate and then buy it from the server.
I guarantee there is something in the TOS that could easily be twisted or interpreted to say its a violation. Almost every one of those things has something along the lines of "Any action that is not intended by the developers and/or company is in violation" that can be used as a catch all. One of the few times I got in trouble on an official forum I was told to read the forum rules. The rules seemed fine until the last one said "Anything that the moderation team deems as a violation of policy is subject to action." which basically means "if the mods don't like a thing they can do what ever they want about it."
