Would be true if people didn't just press accept without thinking.

Unfortunately though people do.

If people choose to accept, then they are agreeing one way or another. Their ability (or inability) to reason about whether it's a valid kick or not is ancillary to the fact that they are required to make a choice. In nearly two years of playing, I think I've been kicked from a DF group once, maybe twice, and both times I probably deserved it.
