logical approach to DPS meter ingame

I was reading a Dev post the other day...

Has anyone ever officially been disciplined for a parser just for using one because of "3rd party tools" or what have you?

Or is this a case where you aren't disciplined for the parser, you're disciplined for harassment.

For example:
If you tell someone "I use a parser" and they report you, is that enough to be disciplined?

Or do you need to harass someone like "noob, your DPS is terrible!" and they report you.

Official, strict-reading of ToS is that "I use a parser" is enough to be disciplined.

Reality, though, is that no one has ever been disciplined for "I use a parser" and SE has unofficially stated that you must be using the parser as harassment in order for them to go through with some sort of disciplinary action.
