Lol, iffy legal grounds? SE would not be the first to offer preorder bonuses after a reasonable amount of time. Besides the fact that these items digital items are theirs to do with as they wish and they could delete them off your account without recourse if they wanted. This is silly season.

Adding these items to the cash shop hurts no one. Except the people who can only enjoy a thing if other people cant have it, like children who scream and cry when they see someone else as Elsa for Halloween.
