I know you're being facetious, but I believe they've clarified it before as a matter of intent.

Someone dying repeatedly in a trial because they just don't get the fight would not be deliberate obstruction of your gameplay. Someone dying in a trial repeatedly because they're deliberately screwing up mechanics to wipe the party as they think that is funny? That actually would most likely count, yes.

It is exceedingly unlikely people just consistently somehow accidentally change into Ironworks gear every time they queue into Alliance roulette; even i this thread, folks unashamedly say they're doing so deliberately because Crystal Tower is the least amount of time for the same rewards.

So while I don't know if Square-Enix would treat it as a TOS violation, you can certainly make a solid argument that it is, especially as there's demonstrable intent to manipulate the system.
