    If this were a real thread then this would be the obvious answer.

    Vote kick. If the group decides they want to bring him along despite his inability to perform then you accept it. Otherwise the kick passes and your issue is resolved.

    I will admit the whole 'can I use illegal software to potentially get the person banned' angle is hilarious, though. Seeing some of the responses here really highlights how toxic this community is.
