Regarding the situation you claimed happened with your brother... If it did in fact happen, and as much as it may suck, that's on him. Err on the side of caution. If someone looks very young, don't. You don't just throw all caution to the wind and jump into the situation. By all that is good in the world, why does it need to be said over and over that a childs' mind is still developing, and that you can't just treat them as tiny adults? They do stupid garbage all the time, and they always want to feel/think they're more grown up than they are... Then, when they get older and look back on those days, they think "what the hell was I doing", or even worse "why didn't anyone try to stop this?"

We have child protection laws in place to keep them from being taken advantage of as they have been throughout human history... Unfortunately, there are still those that slip through the cracks, even in more westernized societies. It's up to adults to prevent that from happening, NOT tell them "it's your fault this happened to you."
