Yeah sure, the devs want us to use 3.5 acessories in 4.0 content. Makes sense.

Did you start 4.0 with 4.0 accessories..or did the game give you 4.0 accessories to you for free upon log in. If these items still have use..then where's the exploit..

It is when people bypass the ilvl requirement then switch to lower ilvl gear. It's obviously not intended.

While it does happen to be poor design, I'm more likely to believe it was an oversight on their part, having forgotten about (or repressed) the STR tanking meta from Gordias.
