Max vs not max is irrelevant. The principle, buying gear, power (levels), content wins, remains exactly the same regardless of when it is purchased.

And you are correct, context is everything. Under no context should buying power, buying levels, buying content clears or wins, ever be permitted. Someone (without source) even said Yoshi had said something to that effect (though not the words I just used).
