For situations like these, get the party leader to not replenish ranks for a few minutes. The tank in your story only gets three withdrawls trying to re-find your party until he's forced to wait 30 minutes.I don't think there should be a penalty for the kicked person, 'cause I've seen/been kicked for no reason. Why should I be punished for that?
However, they should definitely make if so if the kicked person re-queues, they don't end up in the same party. I had a party once where the tank wasn't wearing an oath, pulling everything, and belting out Rick Roll lyrics. And we kicked him 3 times just to have him re-queue and end up in our party again. We ended up having to disband because we all used our vote kicks on him.

5 mins
7 vote yes in 8 person content.
3 vote yes in 4 person content.
Doesn't apply to Offline vote.
Commendations.
If I play dps I only give it out to other dps.
If I play tank I only give it out to healers.
If I play healer I only give it out to tank.
Only if they should be getting a commendation.
There are always exceptions to the rules!
Considering how often I've been kicked wrongly and how often I've seen others be kicked wrongly, I'm going to have to oppose this suggestion.
I queue for WoD while questing, in cutscene part my queue pop-up and I just ignore it until the timer gone but cutscene still not done yet and re-queue again. It happen 3 times and I got the penalty, I'm not mad and I know they make that to prevent from trolling.
In instance some player maybe got connection issue or they PC hang, it's not fair if they got kick and at the same time receive the penalty.
I would be agree if afk player not receive any loot if they not participate in certain boss fight.
We waited a few minutes before we looked for a tank after he rejoined the first time. We still got him all three times.
It was just some really bad luck, I think. I've seen the same player come back once, but never three times in a row.

Yeah, no. I'm against this with a passion and this will, thankfully, never happen. SE should do something about players reentering queues. No one in their right mind would or should give players the power to assign game restricting punishments though and it's not just vote kick abuse that kills this idea for me. I don't think that a group of players who disagree with how another paying player is playing should be able to preclude him or her from all duty finder content for a set amount of time based on their judgement alone.

Am i the only person in the whole game not perpetually getting vote kicked?
When in doubt, assume sarcasm
Nope. With this game's community though, it shouldn't be hard to believe that some people will encounter groups on a somewhat regular basis that use the vote kick feature very loosely.
I personally see the feature abused more often than it should be being abused. With SE failing to back up their claim that it's punishable, I'm sure people are even less reluctant to abuse it.
Instating a penalty on people who were wrongfully kicked would be adding insult to injury, and placing too much power over a person's gameplay in the hands of other players.

Never been vote kicked since vote abandon implemented, but I use the function to kick AFKs/Offlines/Trolls all the time.
But that 4hr CD sucks especially when the damn troll rejoins, SE said they been looking at it for a year+ now trying to make it so they cant rejoin but seems to not get anywhere.
And also the sheer amount of lazy bads you meet in WoD - ignoring all mechanics - DPS boss only - especially easy to see on the first boss when they fucking die every mortal ray and get people killed on lvl150 death/flares.
From the look of this thread, yea... they can keep the thing penalty free but decrease the 4hr CD plz.

getting kicked is a punishment on its own, especially for people who get kicked unfairly.
there's also the cases that we have to kick disconnected/offline players. they didn't do anything wrong and shouldn't get any more punishment.
