The first thing that came to my mind is that RMT could change their names and get off the blacklist. Alternatively, those who have been hacked and were shouting RMT spam against their will could get a second start without having to start all over again. It really is a double-bladed sword.

It's pretty clear that the blacklisted name is tied to the account, so a blacklisted person who changed their name would remain on your blacklist, just with a new name.

If Square operates this like every other game with an /ignore list, then that won't happen. Games like WoW or ToR (those are the only two i've played since XI), are tagged to the character itself, not the name.

Though, I already know that blacklist just tries to hide the text rather than actually blocking a person from sending you messages.. so who knows how their broken system would be with name changes.

The amount of abuse that you think will happen is far higher than the abuse that will ever happen. Of course there are going to be people that abuse the system, though the guild-leaders that do this will be few and far between; And if someone was to take the gil and run, they would more than likely move off server as there would be no chance of someone recognizing them at that point instead of trying to act different for any end-game groups that might know them by their old name (It's very hard to change mannerisms, even the 'speech' pattern in how you type.)
