As OP and most people have said, there shouldn't be any reason you cannot trade a damaged item to another player. Selling, I can agree with, but when I am playing with friends, I would like to be able to share some of my things, especially if I don't need them anymore. If it's that much of a problem just give a little notification to the player receiving the damaged item if they really want it or not.

    "The [item] is damaged.
    It's condition is 67%.
Would you still like to accept?"

    Something along those lines.

    This. Exactly.
The reason for the limitation is obviously to avoid having players accidentally buy damaged gear. Unfortunately, this also prevents players from knowingly buying damaged gear. Another case of mechanisms to prevent abuse getting in the way of legitimate play. This confirmation should also be extended to bazaar items... if, as a crafter, I want to go around collecting damaged gear and try to resell it in repaired condition, why shouldn't I be able to?
