if that's the case, why wouldn't I qualify for it? I didn't delete my character during 1.0, if it was carried over to ARR, why would the GMs say I don't qualify for the legacy mark?

The account doesn't qualify for the mark. The character if restored does, but only that character. It's also not something gms have control over. Either the character has the flag for the mark or it doesn't.
/legacymark will turn it on and off.

Yea, i understand, but the GM is telling me even if i restore my old character, that character wouldn't get a legacy mark because i don't qualify for it. I don't understand why don't I qualify when I met all the requirements.

I dont think the GM understood the question. You need to get past that part. YOU don't qualify for the legacy mark. The character, when restored, will have the mark, if it is indeed the 1.0 character. Nothing else matters or is relevant.
Its not a separate thing that gets enabled on a character. The GMs have no ability to look at or change anything. Its in the char data itself.

I wonder if maybe the GM is conflating the legacy mark with the legacy account. Or maybe since it was deleted, it internally deleted the flag stating it was created in 1.0.
At any rate, if they do a retore, is there any negative for you? Like is it just a matter of "lets see what the character comes back with", or is it going to freeze your account for an uncertain amount of time while SE works? Would it delete any other characters, etc?
Well, I believe this is one of those one time request per account. So if I ask to restore, and that character doesn't have the legacy mark, that would mean I can no longer ask the GM to restore any other characters attached to this account.I wonder if maybe the GM is conflating the legacy mark with the legacy account. Or maybe since it was deleted, it internally deleted the flag stating it was created in 1.0.

Ahh, so bit of a tough call possibly. I know in all my years of playing I've never needed to use the one-time restore, but I also realize that we all have different circumstances and situations that may pop up with our accounts. Personally, I'd probably be waaay too curious to NOT do the restore. lol.
But yeah, definitely give that one a think.
