No, not at all. I preordered because they advertised the ability to play the game early. That has not happened. If the advertisement said "Preorder so we can use you to test our servers, while understanding that you probably won't get to play," I wouldn't have done so. You see how this works? If you advertise a product, be ready to deliver it, or you risk a lawsuit, which is what should be happening soon.

A lawsuit most likely wont happen due to terms of service that you agreed on. Plus, all expansions after ARR has been like this. This isn't new. Does it suck? Yes of course. It sure does. But eventually the kinks will work itself out like always.

Honestly, this early access was way smoother than expected, unlike the previous expansions.

I'm a bit amused; this is the same type of attitude that comes from the Karens who yell and threaten service workers on Black Friday because they're angry the line is long.

This is what happens with new releases. This is an MMO, millions of people play it, and a new shiny toy was just put on the market. Server demands are high, and the team is scrambling to troubleshoot. If you sign up for early access, you signed up for beta testing. You didn't agree to a perfect product, you agreed to play with a nearly-finished project.

With things like this, the dev team cannot possibly anticipate what weird problems will crop up, so this is the time they do field testing and fix problems that arise.

From what I've been seeing out of them (including that incredibly tasteful post they submitted themselves, to the Tech Support forum no less) this concept might be a little too advanced for them.

Terms of Service have been thrown out in court several times. You can't put in a provision that says you can't be sued over your poor handling and expect people to be legally bound to it. There was a contract between everyone who paid Square for this early access and Square themselves, and Square did not fulfill that contract for literally tens of thousands of people so far.

No, technically it was fulfilled. You were able to HAVE Endwalker at an earlier date than the promised official date. You were able to download EW on the promised early access date. The start screen on the promised early access date, had the expac's name, "Endwalker" smacked in the front.

It did not say that you are able to have a guaranteed playtime if you pre-ordered Endwalker.

TOS has no legal bearing in the court systems especially when misleading your products. Seriously, talk to any lawyer, it's not honored at all. All TOS does is allow SE to dictate how the product can be used and SE's right to revoke your license of the game should said guidelines be violated. US is a little more forgiving to corporations over this but EU will straight fucking slam them for this.
