Terms of Service have been thrown out in court several times. You can't put in a provision that says you can't be sued over your poor handling and expect people to be legally bound to it. There was a contract between everyone who paid Square for this early access and Square themselves, and Square did not fulfill that contract for literally tens of thousands of people so far.

No, technically it was fulfilled. You were able to HAVE Endwalker at an earlier date than the promised official date. You were able to download EW on the promised early access date. The start screen on the promised early access date, had the expac's name, "Endwalker" smacked in the front.

It did not say that you are able to have a guaranteed playtime if you pre-ordered Endwalker.

TOS has no legal bearing in the court systems especially when misleading your products. Seriously, talk to any lawyer, it's not honored at all. All TOS does is allow SE to dictate how the product can be used and SE's right to revoke your license of the game should said guidelines be violated. US is a little more forgiving to corporations over this but EU will straight fucking slam them for this.

You see how this works? If you advertise a product, be ready to deliver it, or you risk a lawsuit, which is what should be happening soon.

Advertising has plenty of leeway on how you can present a product to the public, any lawsuits that bring this up without anything substantial, of which there is not, will be thrown out of court. Anyone who has followed games lawsuits would know this

Sorry, but no. I work 7 days a week. They delayed the launch, then when they finally launched, the product was not what they advertised. It's 100% Square's fault, no matter how much boot you lick. I can't wait to see the lawsuits brought up for their horrible handling of this, at least as bad as Cyberpunk 2077.

Cyberpunk 2077s lawsuits all but fizzled out as you should know if you're bringing them up, there is only two lawsuits remaining, one about fraud which is currently undergoing another investigation since the last 3 showed no fraud. And one from the investors which is expected to also be thrown out.

So based on your logic, you're asking for lawsuits just to tie SE up in court for a couple months and then fizzle out? Kinda weird bud

they literally came out with an article just before Early Access launch mentioning all the things that could go wrong, all the things that will most likely go wrong, what all the errors mean, and that they will do their best to monitor the situation as things come up...

to expect that this was going to launch with absolutely no server related issues or anything what-so-ever is just silly... especially when every MMO expansion/standard launch has gone the exact same way. it's really not that far out of the norm nor is it really that big of a deal...

edit: especially after all the attention the game has been getting. it's population is at an all time high, and SE already said that they have been doing their best to prepare but given semicondutor shortage things haven't been easy. They also had to delay the Oceanic Data Center for the same reason I believe
