it just shows its face to the public every expansion when they revise TOS and this thread always appears,you could have been banned or warned this entire time.
It depends on how you handle it. There are civil ways of correcting problems, and uncivil ways.I don't see how identifying the problem and communicating it to the group is "behaving uncivilly toward a specific player." If someone is consistently holding the group back then it should be addressed. This is Square directly enforcing an unhealthy and unhelpful party dynamic.
I imagine part of what SE would take into consideration is whether a player is the party leader. It is reasonable to expect a party leader to offer instruction to party members, and to try correct members who are failing to perform their duties. It would still need to be handled in a civil fashion. It is less reasonable for someone who is not the party leader to do it though I imagine SE is still going to look at logs to try to determine what exactly happened.
Keep in mind that potential for penalties go both ways. If you're joining a duty, the reasonable expectation is that you are prepared for the duty and will make a reasonable contribution to the party's progress. Someone who is hindering a groups progress can also be penalized for doing so. They can't just join a party then do nothing once in the duty, expecting the rest of the party to carry them. That's obstruction of the party's game play and can be reported.

highly unlikely. If you leave because you're being abused, there is evidence of such and since GMs generally lock you in jail to discuss your infringement in game you will have a chance to present that fact.

That's exactly what flares the discussions, people don't read the ToS, or have an approaching knowledge of them. People rely on shady personal experiences they have heard form a friend's friend and will yell at the rules being too tough.
I think that it is quite fascinating how some of the same people accusing others of being hysterical just so happen to be using rude language that falls foul of the terms of service within their posts, making their contributions to the discussion far ruder than the posters they are supposedly criticising.
At the end of the day, it isn't an unreasonable concern in the present day to be wary of individuals and groups seeking a free ride, placing a burden on other members of their team and generally operating in a way that leads them to feign offense in order to weaponise the terms of service to their own benefit.
Perhaps it would be of benefit if Yoshi-P and his team worked to draw some red lines in the sand that go in the opposite direction for a change. Where players are urged to try their best and avoid wasting the time of veteran players as they, in turn, are under no obligation to spend their free time carrying players through content.
There's also a big difference between punishing someone for being rude and punishing a player for quietly taking their leave because they do, in fact, not want to spend their precious free time stuck in a duty that sometimes is obviously not going to be cleared if the other members of the group are not pulling their weight and/or are very undergeared.

Situations i been in irl where been ganged up on and i took it and reported later then nothing happened kept getting ganged up on until i snaped and got sent to a group home for a while.
I dont trust authority to listen when it comes to ppl ganging up

I knew coming into the forums that instead of focusing on the good of having rmt advertising in pf being bannable the people would focus on more fear mongering about not being able to say anything ingame without being banned.
Just be a nice person, is it that hard? You can still talk, everyone can, just don't be a douchebag to people. It's that simple.
Trusts are looking like a far better option in 6.0 as opposed to taking chances in duty roulette with single-pull tanks who still follow the "you pull it you tank it!" mentality in 2021 and people who cannot follow basic instructions in fights like Nabriales, Tsukuyomi, Titania, and SoS.
