It's a common practice to hold LB3 unless you can get two in case you need the healer LB3. It's a pug, entire parties die in 24 mans all the time, you have no idea how many people in your group know the fights etc. This is not just a savage prog thing. It's very common in regular content.

This is completely wrong. Using LB3 as soon as it's ready doesn't do anything for you, and in regular content blinding everyone during a mechanic that can kill people is more likely to wipe the group than using no LB at all. Recovering after an LB3 in something like 24 mans happens literally constantly all day and isn't a problem, but if you wipe a 24 man intentionally using RDM LB3 during a mech, you do deserve to be banned for that, as that's blatantly breaking ToS.

I just do not see SE punishing players without hard evidence not just a pattern. Their history also supports this stance.
It's not about using an ability. There is no reason for them to use it, and then they use it intentionally to kill people. SE does frequently ban people for doing this in other ways, and this is just one more of them that should start being punished if they're not going to make it possible to turn off LB effects.
