I don't care how they do it if they were to. I dont care if you know my parse. I have No insecurities about my gameplay!

I do not want it to be handled by an unofficial third party. Espescially since it's stated as a bannable offense in the ToS! Eeeespescially when it's forcing us into it! It's flawed and leaves room for abuse.
Who knows what the third party is looking at behind the covers.

SE can tell you personally today "we don't care i if you parse lol" and permaban you next week for paring because it's agains ToS.

    It's not sorted.

If the third party effects you in no way, why do you care? Youre saying "I dont care about my information, but I dont want my information to be touched by a thirdparty. But remember I dont have any problem with my information."

And you keep resorting to the ToS, failing to understand what people are telling you. It's SE's ToS. They DONT have to enforce it if they dont want to. All youre agreeing too in the ToS is that youre agreeing to their rules. Whether or not they punish you is up to them. Like I said before, think of how cops operate. You can be speeding and get pulled over, but it doesnt mean the cop is going to ticket you. They may give you a warning.

Lastly youre misunderstanding FFLogs and ACT. They dont 'force' anything. At its core, FFLogs is just a public blog where people can post their combat logs. If you get caught up in someone elses combat log doing a public action, then thats that. ACT just takes combat log information and presents it in a more readable format. Nothing more. It isnt 'fishing' for your combat logs. It doesnt track your battle information if youre in Lakeland and Im in Mor Dhona. It doesnt seek out players and twirls it's mustache evilly thinking "Nyah, Gonna suck up all that sweet sweet combat info!"

If youre in a party and you do something, it shows up in the combat log. I can see that, you can see it, everyone in party can see it. FFLogs just posts that information into a web format that can be reviewed. Thats it. This, btw, can be accomplished without ACT. People can literally math this stuff out themselves and post it to a website and it would still be the same thing.

Yes. Because thats how ToS's work. You agree to there terms of service, and they can choose to ignore you or not. There is nothing bindnig in the ToS which says they will punish you 100% of the time if your caught violating it. It's always been like that, and it's like that for most ToS's when you look at them in depth. The ToS gives THEM flexibility. If they want to get rid of you for harassing someone over DPS, they can point to the ToS and say "See, its right here." But they can also just the same ignore people who use it and dont say anything about it.

All it is at the end of the day is an organized layout of your combat logs that you can peruse to see where you did certain actions and then deduce how to improve. Nothing more. If people misuse the tool, thats the individual's problem, not the parsers.
