Read the context — Profanity and usage of profanity are actually written in the ToS as being punishable offenses. This is not about that one clause in Prohibited Activities you like to quote about intent, and how punishment may be bestowed if you’re found to violate the rules. If you’re reported for cursing, you’re going to be talked to about it—it’s fairly black-and-white in this instance. The severity of the swear—as well as any prior reports—are likely to determine which kind of “talking to” you get (e.g., warning, temp-ban, etc.).That is (still) not what the ToS says. And as I have said before, I expect it's to be applied when someone claims they didn't mean offence, but clearly did, and the GM needs more power than "one person's word against another" - and to solve what was apparently an issue with the old ToS that someone couldn't get in trouble for doing something unless they explicitly stated they were doing it deliberately.
My talk about “whether this was your intent or not” is more so applied in a sense of “you were talking to people who obviously are aware that you use this kind of language—but Bobby over there saw your language and he didn’t like it, so he reported you for it”.
You’re more likely to get punished for cursing in this game than anything else because it’s something that can be easily confirmed via logs. If you’ve cursed before and have walked off scot-free, that’s more likely because you were never reported. Not that a GM read the report and was like “meh, it was okay for them to use the F-word this time”.

Ah, of course. I'm up too late and context did not compute.
And yes, I do "like to quote" it (but not because I like bringing it up over and over), because people keep misinterpreting it and ranting against the misinterpretation as if it were fact. And I hate incorrect information getting passed around.
