    It's not against tos because for all se knows the players are trading gil for a clear which is fine. However we all know people are paying real money and lots of it for a clear, and on top of that, the person getting the clear isn't even playing, someone else is playing for them. However since all of this takes place out of game, the transaction, the discussing, etc, se can't do anything about. They can only take care of things in game, and not 3rd party resources. Is this dumb? Yes does this affect your play? Probably not.

    They can though. IP logging exists. It's beyond obvious, I'm sure, when someone else uses your account, especially when during that time you do something you were unable to do before. SquareEnix doesn't need hard proof to make a case against the player in question. Their ToS says they can terminate your account whenever they want for whatever reason they see fit. If it's this obvious to the players that these people are engaging in RMT then it should be to the staff. They most certainly can do something about it and have had the power to do something about it since the most recent variation of their ToS.
