The bots I'm thinking of are ones used for personal gain, not RMT, such as the gather/craft bots and PvP bots. There's no benefit to allowing these guys to persist like there is with the RMT bots, as they won't immediately replace themselves if they get banned. They're also disrupting people's gameplay about as badly, if not moreso then the people abusing Ungermax, as the former have tanked the prices on certain crafted/gathered items to the point where it's scarcely worth the time investment for legit players to try to sell them anymore, while the latter are effectively handicaps for whatever team they end up on.
And while what you say is true, the problem is if they always have to give players the benefit of the doubt, how can they ever be 100% certain someone is botting to the point of it warranting a ban? Outside of using some kind of software to detect whether a player is running programs that are interacting with the game client somehow, there really isn't any way, so it gets to a point where they have to start making assumptions based on the evidence if they ever want to get anyone banned. That includes banning even players who aren't unresponsive, as I know for a fact that most of the bots on my server are usually being run alongside a main account that's being played actively, so the basic "Send a tell and see if they respond" test won't work.
Though fundamentally, the main issue lies in XIV's coding being so shoddy and easy to manipulate/read.
It's best to prevent these things from happening in the first place, and judging from their "fix" to prevent illicit activity that came out in 4.2 (They moved the valuable items in Amdapor Keep's chests to a later part of the dungeon, but when you're dealing with bots that can teleport literally anywhere they want at will, that doesn't accomplish anything...), they really don't seem to know how to properly stop the gil-farm bots.

I love the whole "I have never botted or used this cheat in Endgame" is immediately followed by "We used it to mess around Nael for prog in UCoB."

That said, he somewhat confirms the players in his static who never manually used the command despite partying with it up are getting no messages or suspensions.
Bannable offences tied to the player writing something in chat mode versus bannable offences players can do without writing in chat mode. Most "player" actually do the latter, most bans are for the first though. As long as it is like that, these bans don't really feel fair to me.
Engage spam bug was not intended aswell, nobody got banned even though heavily abused.
Scope matters. You can't get anything from Squadron dungeons except low end levelling loot worth a tiny amount of seals, and a bit of exp from your squad. That's a bit different from taking stuff into savage content.
I mean, SE even said they weren't going to ban accidental users of Ungarmax. But if it was in Omega/Ultimate/Extreme stuff... multiple times no less. That's no accident.

The redditor there added in the thread that his Static party has only seen the bans hit him and a second member, both noted for being the regular activators of Ungarmax. The other 6 have, so far, not even gotten a warning.
Plus, doesn't the Ungarmax tooltip even say it's for Squadron Missions only? How more obvious could it be?
So that's the thing. It's possible that some people had it macro'd or whatever and never expected it to work outside. But then once they hit that button and it does. That's probably why SE said they're not going to punish accidental users. Nothing willfully ignorant about it.
All that said, using it multiple times in progression raiding, there's no excuse for that.
