I don't know why SE is being so jumpy about people playing other peoples' music, and about the monumental amount of words or parts of words that may or may not be a racial slur (reputation for example), but have allowed a monumental number of ASCII characters from all over the world to be used in the game that RMT are taking great advantage of it in advertising their websites. Never heard of the saying "you can't please everyone"? Well this is what happens when you try to please everyone.

With regards to the ASCII characters, as far as I can tell, they implemented Unicode in it's entirety. This is hardly surprising given the Japanese basis for the game and thus the need to allow the use of kanji. No one is going to sue SE because RMT are advertising, whereas they might if people start playing copyrighted works and posting them.

But with the disclaimer in place, at that point, Square has covered themselves by stating that the player agreed not to, and can deflect the matter to the player performing the copywritten piece. Honestly, I suspect that was the entire point of the disclaimer. Also, unless someone is recording you and then uploads it, the actual act of you playing anything is incredibly unlikely to ever be known or provable by anyone.

That doesn't mean someone won't try to sue anyway if SE doesn't crack down on it. SE has the deepest pockets and so is the most likely target. Also, it's a new feature, SE may be going heavy initially to make sure people are more careful about what they do.
