Bard Performance Questions

1. Can you do like 8th notes and 16th notes? Or is there a certain cooldown on all performance actions that make it so you only get one length of note?

2. You can not perform 3rd party music. Does this include music that many people can play without getting allowed to copyrights? For example, Canon in D by Pachelbel? This is performed at many weddings and orchestra concerts. I play this on violin and piano a lot and many people make remakes.
-If you can not perform it publically, would I still be allowed to enter my private room and record a video of me playing it? It would just be like me recording myself playing it on violin...except in a game.

I haven't noticed any cool downs on the skills, and videos I've seen on perform make it look like you can hit notes in pretty rapid succession, so 8th and 16th notes should be entirely possible.

As far as the other, I highly suspect that the disclaimer not to perform third party songs is a way for Square to cover themselves and deflect liability onto the player if they do perform content by a third party. It will be interesting to see how that plays out, but I would imagine works that are considered public domain would be generally considered safe to play, as of course original pieces.

Edit: I would also say that public domain pieces aren't actually third party pieces since they don't belong to anyone.

There's a minimum time for executing a note. I haven't measured it with any precision but I've noticed that at a tempo of 1/4 = 100, 1/16 can cause delays in the next note. 1/8 is usually fine. At 1/4 = 120 or faster, 1/16 will almost certainly be out of time.

If you want to record passages with brighter tempos, you might have to split the melody between two tracks to avoid dragging when there are 16ths.

So what is the deal with playing music as a bard. Can you play music or do you risk being banned for playing music? What about music I wrote myself, is that against the rules too?

People who can play music in a game whether it's from the game, a different game, or a record label, have and will play it, and there hasn't been any rules against it nor has there been any lawsuits taken by the people who've written the music. What else did SE expect when they put in that feature, for people to play only Twinkle Twinkle Little Star and Three Blind Mice?

I don't know why SE is being so jumpy about people playing other peoples' music, and about the monumental amount of words or parts of words that may or may not be a racial slur (reputation for example), but have allowed a monumental number of ASCII characters from all over the world to be used in the game that RMT are taking great advantage of it in advertising their websites. Never heard of the saying "you can't please everyone"? Well this is what happens when you try to please everyone.

I wouldn't take the "Performance Actions Agreement" too seriously. I reads like a generic disclaimer. SE may discipline any player for playing a song that is deemed in violation of the agreement. It's meant to be for fun and used for creative expression. SE doesn't heavily police players as is, so don't worry about it and let loose your inner maestro.

With regards to the ASCII characters, as far as I can tell, they implemented Unicode in it's entirety. This is hardly surprising given the Japanese basis for the game and thus the need to allow the use of kanji. No one is going to sue SE because RMT are advertising, whereas they might if people start playing copyrighted works and posting them.

But with the disclaimer in place, at that point, Square has covered themselves by stating that the player agreed not to, and can deflect the matter to the player performing the copywritten piece. Honestly, I suspect that was the entire point of the disclaimer. Also, unless someone is recording you and then uploads it, the actual act of you playing anything is incredibly unlikely to ever be known or provable by anyone.

That doesn't mean someone won't try to sue anyway if SE doesn't crack down on it. SE has the deepest pockets and so is the most likely target. Also, it's a new feature, SE may be going heavy initially to make sure people are more careful about what they do.

Would assume so until you hear otherwise, a few of the songs from FFXIV are even 3rd party music. (Answers, Dragonsong and Revelation iirc)
