Is the vote kick system improperly implemented for how it's actually being used?

They made it this way so there would not be any stalemate. If a person is kicked, then its, because majority wanted him or her gone. If all 4 or all 8 could vote and 50% is for the kick and 50% is against the kick, then there would be a deadlock and the group would not progress.

I think its better this way, its not perfect, but better then a stalemate.

No, actually the current version doesn't mean the majority wanted him or her gone. That's the issue here. A majority of four is three. A majority of eight is five. That's just as straightforward, so there's no stalemates there either, but it can't be abused for what's actually only half of a party to take over as though they were a majority when they're not.
