They are not just any bird though, they were in FFXI. You don't remember how Carrion Crows looked like in East Saruta-baruta? Those are a direct rip. lol

Those birds are clearly ripped from XI. They have identical markings/proportions/apparent behaviour?/even the same floating height.

SE's pretty keen on shutting stuff like this down usually, I wouldn't be surprised if they get round to it eventually. I really hate plagiarism, it's just so lazy, is it that hard to make up your own bird/stupid dog-mount thing?

Not really a gray area. The only time you can possibly get away with it is if no money is being made. That means no purchase, no subscription, no micro-transactions, not even advertising on the site.

Even if you're making no money they can still come in with a C&D order (Like they did with the Chrono Trigger project)

That was legal usage though, they also had a Black Mage character in one of their other sports games too. I'm not sure how it works but I guess Nintendo and Square Enix went through some contracts for this.

Perfect World, on the other hand, has seem to have copied the concept of a chocobo, but its not actually a direct rip. They can possibly back themselves up if they wanted to.

You mean some chinese made MMORPG rip off other game/media's IP? It's nothing new, and yes they can, because they have been doing that for a long time and legality obvious doesn't apply to them. Go have a look at Planet War and tell me how many games/medias it ripped off.

I thought the vultures could have gone either way, despite the fact they had the very FF feel to them, but there's no mistaking a carby. They even got the number of tails right.
