The ToS is deliberately worded loosely not for your benefit of finding loopholes but for SE's benefit of allowing them more freedom to deal with more potential issues than writing every possible past, present and future abuse. They would only update the ToS when such new abuse cannot be covered by one of their previous ones which is not the case for estate/plot reselling as they consider that already covered in the ToS. For example a GM in the thread linked mentioned it falling under inappropriate behavior to resell plots or estates whether through PF or other methods.

I think it is about scam, because you can't sell a house in first place, only to get paid to abandon your plot.

It's not a scam if both parties understand what goes into the transaction and follow through on their end. Person gives you agreed amount of gil, you relinquish plot when it's just the two of you there, you don't buy the plot right back up.

Many off-MB transactions involve a possibility of scam, that doesn't make them scams. If I agree to craft you something with your mats, take your mats, and vanish, that's a scam. It doesn't mean crafting with someone else's mats is a scam.
