If this is happening you have problems that are not being caused by the game design.

Yes, if you let the tank flash/overpower 2-3 times, and attack his target, and you're still stealing aggro, there are bigger problems that are not caused by the game design. That's not what the op is talking about though, unless I misunderstood severely.
