Do you know that Guildleves are instanced events?

Just because the word "Instance" is used, it doesn't always mean "private zone"

Behest is another "Instanced event"

Mobs that can been seen and engaged only by players currently active in the event. If open world NMs were somehow done in this fashion would you still be against an "no claim" system?

It can be such that the claim system works differently with different styles of monsters (normal vs NM for example).
This is actually currently implemented to some degree - it is possible to heal/buff folk who are in combat with standard monsters, but if you attempt to heal or buff someone outside your party when they are engaged with a NM it tells you that you can not as they are currently engaged with an enemy.
NM already function in this manner.
