RMTs use /tell and /shout to advertise too. Guess we should ban any sort of FC or party advertisement through those channels as well?

I fail to see where the abuse is. Worst case scenario, SE adds tabs to PF to separate out these sort of parties.

I'm all for banning FC advertising over both channels, but accept that shout is arguably justifiable (even if it annoys me to no end).
Advertising via whispers though should be banned. As should blind invites (though this should have been taken care of with an auto-reject feature at the start).

Isn't it when you posted a recruitment in Party Finder, you're technically advertising your party? Isn't it the same with those mercenaries? They're advertesing their product, and yet IT IS STILL A PARTY.
