Honestly no, SE isn't losing this fight at all. The gil sellers are on the losing end of this fight, you just don't see it because you are getting so much all at once right now.
When was the last time you saw shout spam? How about yell? Think about it. The shout spam started small, then got out of control when SE started clamping down, and then suddenly just stopped. Why? Because SE made that avenue of attack not worth the effort anymore. Tell spam started small, now is suddenly getting out of control..
Shouting is far more cost effective than mass /tell, yet they started doing mass tell instead. That itself is far more telling about SE's approach to this problem then anything else. If SE were unable to keep up, these people would still be shouting. SE didn't worry about trying to keep up with the shouting itself, because they blocked it at the source. SE added so many filters that the sellers gave up that approach. The tell spam is bypassing said filters right now, but they are also doing so much of it, that SE now has a lot of reported source material to add tell filters/name filters.
SE doesn't have to win this fight by making it impossible for the spammers, they just have to make it prohibitive enough that the sellers don't find it worthwhile enough. From my perspective SE is very close to this, they just need to follow through on systems for filtering tell.
It is getting more and more aggressive right now, because the gold sellers are trying to get as much money out of this game as they can before it is no longer profitable enough to be worth the effort it takes to bypass SE ever more sophistical spam filters.

Well I just checked in game and either the Goldceo's are offline or SE did a mass banning. I'm on Balmung btw.
Has anyone gone into a City and not see it being attacked my Sellers?
It was near impossible to chat in the cities.
I get some, but not a lot anymore. I feel like they are doing better.
This is on Levithan by the way. Gridania has the least.

I think delving deep into the hardcore criminal realm of gold selling in MMO's would make a cool documentary. Someone make this happen.
