There is no "when everyone is logged out" because people from all over the world play this game. They do maintenance when it is most convenient for them. If it coincides with when you can play, sucks for you.

The TOS is never above the law. Just because it says something, doesn't make it right.

I think you should sue them for changing the game at all! You paid for the game in a certain condition. It would be like buying a car and a car lot having the audacity to put new tires on the car for you.
