So, any compensation for the lost time?

This isn't intended to be a complaining thread, and all I would like to know is if there are any plans at SqEx to compensate the people that cannot play because of the issues.

At this point, in a 4 day head start (Saturday to Tuesday), I have been able to play a total of 4 hours (not for lack of trying).

And now, because they are limiting login to the server because of congestion, I cannot even get in to play my characters.

All I want to know is what SqEx is planning for compensation or if they even are thinking of it. Tell me why I should go pick up the game from the store this coming Tuesday?

My guess would be no... unless the issues go on through the first free month, then they'll give us all another free month, and if issues continue through that free months we'll get another, and if issues contin... you know where this is going.

I agree with you, but yea we aren't going to get anything. I had to pre-order a PS3 version of the game so I could get in early access because I had a PC CE from 1.0, but did not get legacy status. I knew it was a gamble ...

Compensated for what exactly? Did you pay an additional fee for early access? The early access is considered a bonus for ordering the game prior to its launch, it's not a guarantee or anything. Furthermore, I assure you if you read the small print on pre-orders (that have an early access) it states that it may change or even be cancelled at the behest of the company in charge of the game. Once the is game actually launched on Tuesday and you are not able to log in and play, then complaints about compensation will be valid. Even moreso once subs kick in.

Sorry but that isn't true, case law and consumer laws say that anything advertised as what you call a "bonus" is in fact part of the purchased product. As an example if you buy a car that comes with a "free" xbox one and it doesn't work (the xbox) you can go back and demand a working one since it became part of the purchase when it was advertised with the product. As such since this was advertised and became a deciding factor in pre-purchasing the game, which is in essence an interest free loan which I won't get in to, it became part of the product purchase and is not simply a "bonus" as I submit it was not reasonably delivered/working. Now legally the right is to ask for a refund but I want to know what SE is willing to do to earn back trust and make up for their crappy mistake. I mean seriously did they not have a legitimate stress test?

Thank you for this. Clear, concise and most importantly-- correct.

I spent 2 hours last night attempting to explain how early access is a paid feature, not an additional bonus to people that just didn't get it. It's unbelievable how some feel gratitude for being allowed early access and not entitled to their advertised purchase like they should. Nice to know common sense is alive and well.

That argument isn't entirely true. If I buy a car, and the car includes a promotion for a Free xbox, the dealership is under no obligation to guarantee that the xbox works. Any and all technical issues with the promotion product need to be handled by the manufacturer of said product. Will a dealership do the right thing to save face? Generally but doesn't always happen.

Plus, consumer law varies state by state, country by country. In the US, for example, our consumer laws are much more lax than say the EU.

Teknina while consumer laws do vary what you said isn't true. The company that gives you a product is expected to hand you a functioning product at the time of purchase. In the case of the xbox we have already established that the xbox became part of the purchase (really part of the contract but that goes into too much depth) unless it is readily understood by both parties that the product is not functioning and the seller better be able to prove that was understood.

Move that here, the EA was promised as part of the purchase as we previously established. The EA currently does not work, now if it was extended until Thursday and release was pushed back then its a different story but as of now they are facing people who have been unable for the vast majority of time (I would estimate less than 25% of the time they have been able to get in) which is where it gets opinionated, a judge would need to decide where its acceptable or not. (Not saying this is court worthy)

As such legally the only right as a consumer is for a refund as in the US digital laws are lax. EU has better digital laws and may be entitled to compensation? I am unfamiliar with EU laws but consumers can choose the law that most benefits them since they can claim their country laws OR where the game is based out of, in this case the US since the servers are there. )At least that is what my reading showed and also what steam says. (The bonus I have dealt with before)

    Boom. I love you.

Also, regarding the ToS: I would say that 50% downtime is an "exceptional circumstance".
