Looking at it realistically, there are only two possible stopgaps (I seriously doubt they'd just think it's a bad idea).
1: they don't want to deal with the "user created content" legal mess, but I doubt it, since they had the ring contest.
2: Yoshida might not want to put in something that resembles him and will probably show up a LOT. If you walk into Gridania and you see an army of little Yoshi-P, it would look funny as hell, but someone may accuse him of being on an ego trip.
Maybe it could be used as an easter egg somewhere more than as a minion to avoid seeing armies of Mini-yoshis all over the place.

It's mostly a problem of perception though.
