Did you actually pay for the 90 day option? From what I've heard, it should give you Legacy a few days after you pay, so you shouldn't have to wait out the full 90 days in order to get it.
I started playing again on May 19, 2012, and got "Legacy Status" just this morning when my automatic payment went through. This is my 3rd payment (3rd month), so even though I've only had this game (re)active for just a day less than 2 months, I have legacy status.
I would wait, and hopefully soon it'll show up!

I had the worst pit in my stomach upon viewing that. Checked my email and it seems I was sent the automated message explaining there was a "processing error with your payment method". My credit card hasn't changed, I have more than enough money available for FFXIV in my account, and I'm currently subscribed to the 90 day payment policy that shouldn't have run out by now... If this messes with my ability to obtain Legacy... ugh.
I would reactivate my character, but in doing so it will revert my subscription method to 30 days, which I'm worried will abolish my chances at Legacy as well. Looks like I'll be calling customer support in the morning...
Also, to specify, no. Upon checking my bank account, they hadn't actually charged me for the full 90 day yet... they were supposed to today, but suddenly SE has decided there's now "issues" with my payment method..?
