ESRB is "irrelevant", but then you essentially state the terms of the game essentially equate to the same, so unless you were shoehorning in some commentary about another country's rating system, what was your point?
No one's trying to argue the ESRB is a world-wide system, but other people have been trying to use it to argue that it has anything to do with what the players get up to instead of just the actual game content itself.
The terms even state that anyone under the age of 18 has to have their parent or legal guardian agree to the TOS on their behalf in order to even play. If little Timmy is twerking his digital self with a bunch of questionable people online, I'd say throw the parent(s)/legal guardian(s) in jail.
Otherwise, by this same logic, every spicy comment made anywhere on the internet should lead to IRL extradition to every country that has a law against the content of the comment.
If that's too much of a leap, I dare say I was only following your lead...
