A ToS does not trump your consumer rights even if you sign it, a ToS is based off the idea of good faith and that the company has to position both the signee and the cooperation on equal footing. They are taking advantage of the fact that lawyer fees are expensive and that no one wants to be caught in a years-long legal battle.
These aren't the laws where I live, and even if they are where you're from its pretty moot because as you said, who is going to personally fund a lawyer to go up against a massive corporation over a banned FFXIV account. Not really realistic. Because clearly they have no issues banning accounts with no reason given. Where I live, so long as they refund the money for subscription time you had remaining, there isn't much you could do.

I don't live in the US, and as far as Im aware the breaking of your consumer rights even if they do refund your funds which they won't is still illegal. The point is still valid even if you cannot afford the ability to legally retaliate. But the ToS is a clear sign of how much they actually value their playerbase.
