I've played this game since ARR early access and have never once been put in a gaol or disciplined in any way. I talk in chat all the time, mostly in duties. Sometimes I even get irritated because yes I do have to explain for the 4th time in this one fight that they need to keep the bosses apart. Yet nothing has ever happened to me. One person even sent a screenshot proving they reported me. And yet, nothing.
People who get put in gaol break rules in some way. Surprisingly, it's actually pretty easy to not break the rules. Reading them is a start, and know what you are and aren't allowed to do. Don't use widespread ignorance to fuel some "talk, get banned" bogeyman.

Fixed it for you.
Square doesn't ban you for talking. Heck, square doesn't even ban you for harassing. You can be quite aggressive, publicly, for months on end without the gm's doing a single thing to try and stop the harassment and slander.
And yet, if you DARE say the F word around somebody, 3 day.
That’s not entirely accurate either. I genuinely have no idea what their criteria is because there’s someone I see at hunts who regularly ,not just drops f bombs, but aims them at people in /shout. I obviously can’t repeat what he says but imagine ableist slurs, racial slurs, misogynistic comments, always preceded with an effing. I’ve reported him and seemingly no punishment. He’s on every day so wasn’t suspended and he still swears and harasses people so unlikely he even got a warning if he’s not corrected his behaviour over the course of a year.Fixed it for you.

There’s definitely something shady behind the privacy policy.
