The problem isn't Swifcast CD, it's people being to hurry to just wait protect.

If they only did it once it would be extremely petty of someone to go as far as reporting them for it.

No. Early pulling in hunts is a thing the player community came up with (SE intended hunts to be a "you saw it first, you kill it first. Wait if it's a strong one, though and then pull when you think there's enough"). If the healer kept pulling before the tank, even after being asked not to, then it would fall under 3.2 on the ToS (especially if it causes wipes).
Even then, "Early Pulling" only became a phenomenon from PS3 load times being so long that it put a chunk of the player base at a "disadvantage" when hunts first started.No. Early pulling in hunts is a thing the player community came up with (SE intended hunts to be a "you saw it first, you kill it first. S-ranks need multiple parties to kill when on level, so waiting on PS3 friends was less a courtesy and more a requirement in ARR and HW (though less so in HW as many were already upgraded to PS4) but this turned into waiting on about 100 players to show up on short notice, and it was a mess, since that slowed load times further.
So, early pulling was PS3 limitations.
