It is (or at least some GMs interpret it that way), but technically that didn't happen here. What was sold was the ownership of FC (and full house access and the ability to remove everyone else's access just happened to be included in that). The loophole that GMs are using to punish people selling housing plots, is that it could be considered a scam. What they're actually selling is the fact that they will relinquish the land, but the seller cannot guarantee that the person they're "selling" to will be the one to buy up the land once it becomes available (a third party could come in and buy the property once it's been released).
In this case, your new FC leader transferring ownership of the FC to this other person. There's no room for ambiguity, he's inviting the other person to the FC, then making them leader, and accepting gil before or after the process. Since there's nothing in the ToS directly against this sort of behavior, the GM's hands are tied.
