I've seen this happen too often. Now I don't roll on any loot and just let the timer run out as it will extend into the following boss fight preventing the ability for the kick function to be used.

^This! I know if you really need a piece of loot, you'd have to wait until like 5 seconds or when the boss is pulled, but it really helps against people kicking between bosses so they can get the loot they want.

Also, I don't understand the kicking thing... if one of them is not party leader, someone else will choose to replace a dps, THUS getting someone else that will be rolling on the items that the first person was kicked for.

Yep. This. People who deserve to be kicked take advantage of this. No reason not to do it yourself for the sake of self defense.
