when they acknowledge that they won't enforce a rule unless it causes problems... that's a lot different than shoplifting. unless you're analogizing to a fictional world where stores acknowledge that shoplifting is okay as long as you keep it hush hush.

Regardless of what Yoshi says, they will abide by the ToS. If you get busted, Yoshi isn't going to come to your aid.
