The difference between companies like SE banning videos is that they provided free beta keys and access, and have a Non-disclosure agreement. hence you break the agreement and they ban your video they can also sue. It's a breach of contract. What EA and Microsoft are doing is borderline illegal, hence why they can have issues with the FCC. The case is that they pay people to review their games only in a good light.
